Welcome to www.terragarden.com, operated by Terra Garden Co. ("Terra Garden," "we," "us," "our"), a company registered in the State of Kuwait with its principal office at Marzouq Rashed Al-Rashdan Street, Saud Abdulaziz Al-Rashed & Sons Building, Block 1, Plot 1832, Ground Floor, Unit 13, Al Rai, Al Farwaniyah Governorate, Kuwait. These Terms of Service govern your access to and use of our website, our online shop, and our design and installation services (together, the "Services").
By accessing the Services or placing an order, you agree to these Terms. If you do not agree, please do not use the Services.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract under the laws of the State of Kuwait to place an order or commission a design project.
2. Products and pricing
All products are listed in Kuwaiti Dinar (KWD). Terra Garden makes reasonable efforts to present products accurately, including photographs, dimensions, and care details. Because live plants are natural products, the plant you receive may vary in size, shape, and colour from the photographs displayed. This is not a defect.
Prices and availability are subject to change. We reserve the right to correct pricing errors, refuse or cancel orders resulting from obvious errors, and limit quantities.
3. Orders
Submitting an order through the website is an offer to purchase. Terra Garden accepts your offer when we send the order confirmation email; a binding contract is formed at that point. For custom terrariums, green walls, and commissioned installations, the binding contract is formed when a separate written quotation or service agreement is signed.
4. Payment
We accept K-Net, Visa, and Mastercard online, and bank transfer or cash for larger commissioned projects. Payment is required in full before delivery unless a specific credit arrangement has been agreed in writing.
5. Delivery
Delivery is governed by our Shipping Policy. Risk in goods passes to you at the moment of delivery.
6. Returns, refunds, and Plant Health Guarantee
Returns, refunds, and the Plant Health Guarantee are governed by our Returns Policy and Refund Policy, framed in accordance with Kuwait's Consumer Protection Law No. 39 of 2014.
7. Design and installation services
Custom commissions — green walls, bespoke terrariums, palace and villa landscaping, maintenance contracts — are governed by a separate written agreement that specifies the scope, price in KWD, timeline, payment milestones, and warranty terms. These Terms of Service apply only to the extent they are consistent with that agreement.
8. Intellectual property
All content on www.terragarden.com — photographs, text, graphics, logos, designs, and the layout of the website — is owned by Terra Garden Co. or licensed to it. You may not copy, reproduce, republish, or use our content for commercial purposes without our prior written consent.
9. User-submitted content
If you submit photographs or reviews to Terra Garden (for example, through Instagram mentions, WhatsApp, email, or a review platform), you grant Terra Garden a non-exclusive, royalty-free licence to use that content in marketing materials with attribution to your first name and Kuwaiti neighbourhood, unless you request otherwise in writing.
10. Prohibited use
You agree not to use the Services to transmit unlawful, infringing, or harmful content; to attempt to gain unauthorised access to the website or its systems; to disrupt the Services; or to use the Services in any manner that breaches Kuwaiti law.
11. Disclaimers
The Services are provided on an "as is" and "as available" basis. Terra Garden does not warrant that the website will be uninterrupted or error-free. Plant care advice provided by our team is guidance based on general experience with Kuwait conditions; outcomes depend on placement, care, and local factors we cannot observe remotely.
12. Limitation of liability
To the maximum extent permitted by Kuwaiti law, Terra Garden's total liability arising out of or in connection with any order is limited to the amount paid by you for the specific order that gave rise to the liability. We are not liable for indirect, incidental, or consequential losses.
13. Governing law and jurisdiction
These Terms of Service are governed by the laws of the State of Kuwait. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent Kuwaiti courts.
14. Changes to these Terms
Terra Garden may update these Terms from time to time. The version published on www.terragarden.com at the time of your order applies to that order.
