This Privacy Policy describes how Terra Garden Co. ("Terra Garden," "we," "us," "our") collects, uses, discloses and protects your personal information when you use www.terragarden.com, visit our studio in Al Rai, or engage our plant and botanical design services in the State of Kuwait.

This policy has been prepared having regard to the requirements of Kuwaiti law, including Law No. 20 of 2014 on Electronic Transactions and the Data Privacy Protection Regulation issued by the Communications and Information Technology Regulatory Authority (CITRA).

By using our website, contacting us, or purchasing from us, you agree to the practices described in this policy. If you do not agree, please do not use the website or send us your personal information.

1. Who we are and how to reach us

Terra Garden Co. is the trading name of Terra Garden W.L.L. (شركة تيرا جاردن ذ.م.م.), a Kuwaiti limited liability company. Commercial Registry No. 344675 · Trade License No. 2012/2399.

2. The information we collect

We only collect what we need to serve you well.

a) Information you give us directly:

  • Contact details: name, mobile number (Kuwait or international), email address, and — where you choose to share it — your company or organisation name, when you use the contact form, WhatsApp, or email.
  • Order and delivery details: billing name, delivery address (Governorate, Area, Block, Street, House or Building), and order contents when you purchase from our online shop.
  • Project information: site details, photographs, measurements, and design preferences when you commission a green wall, terrarium, or interior landscaping project — whether residential, a diwaniya or majlis, an office, or a palace-scale installation.
  • Payment information: card or K-Net details, processed directly by our payment service provider. We do not store full card numbers on our servers.
  • Marketing preferences: your email address and name if you subscribe to receive updates from us.

b) Information we collect automatically when you visit the website:

  • Log and device data: IP address, browser type, device type, pages viewed, time on page, and referring website.
  • Cookies and similar technologies: small files placed on your device so the site can function (for example, keeping your shopping cart and language preference) and so we can understand how the site is used. See Section 7 for details and your options.

c) Information from third parties:

  • Payment processors and K-Net confirm the success or failure of a transaction.
  • Delivery and logistics partners confirm the status of your delivery across the Kuwaiti governorates.
  • Social networks (Instagram, Facebook, X, LinkedIn, WhatsApp, YouTube, Pinterest) may share limited information with us when you interact with our pages or click a share button, in line with their own policies.

We do not knowingly collect personal information from children under the age of 18. If you believe a minor has provided us information, please contact us and we will remove it.

3. How we use your information

We use your information to:

  • Respond to enquiries in Arabic or English, prepare quotations, and schedule consultations.
  • Fulfil orders and deliveries across Kuwait.
  • Design, install and maintain green walls, terrariums, and interior plantscaping — including corporate, hospitality, and palace projects.
  • Send order confirmations, delivery updates, and service reminders (for example, that your next maintenance visit is due).
  • Send marketing updates you have opted in to receive; you can opt out at any time.
  • Keep our records and manage our accounts as required by Kuwaiti commercial and tax law.
  • Improve the website and our services based on how people use them.
  • Protect against fraud, abuse, and legal risk.

We do not sell your personal information.

4. Legal basis for processing

We process your personal information on one or more of the following bases, consistent with CITRA's Data Privacy Protection Regulation:

  • Your consent — for example, when you subscribe to marketing updates or submit the contact form.
  • Performance of a contract — to fulfil your order, deliver your plants, or carry out your project.
  • Our legitimate business interests — for example, fraud prevention, service quality, and record-keeping — where these do not override your rights.
  • Compliance with our legal obligations under Kuwaiti law.

5. Who we share your information with

We share information only with the parties we need to, to run the business:

  • Service providers that help us operate the website and the business, including our website host, email and messaging platforms, payment processors, K-Net, delivery and logistics partners in Kuwait, cloud storage providers, and analytics providers.
  • Professional advisors such as lawyers, accountants, and auditors, where we need their advice.
  • Authorities and other parties where Kuwaiti law requires or permits us to share information, or where sharing is necessary to protect our rights or someone else's safety.

Where any of these providers are located outside Kuwait, your information may be transferred to and processed in other countries. When this happens, we take reasonable steps consistent with CITRA's regulation to ensure your information continues to be protected.

6. How long we keep your information

We keep your information only for as long as we need it for the purposes set out in this policy, and in line with Kuwaiti legal retention requirements. In practice this usually means:

  • Enquiry and quotation records: up to 3 years after last contact.
  • Order, invoice, and tax records: as required by Kuwaiti commercial and tax law (typically 5 years).
  • Project, installation and maintenance records: for the life of the project plus a reasonable archive period.
  • Marketing list data: until you unsubscribe; then removed on our next scheduled cleanup.

7. Cookies

We use a small number of cookies and similar technologies so that:

  • The website works (for example, the shopping cart and your Arabic/English language choice).
  • We can understand how visitors use the site and improve it over time.
  • Where applicable, we can measure the effectiveness of our advertising and outreach.

You can control cookies through your browser settings — most browsers let you block or delete cookies. Please note that blocking essential cookies may mean parts of the website do not work as intended.

8. Your choices and rights

Consistent with CITRA's Data Privacy Protection Regulation, you may:

  • Ask us what personal information we hold about you.
  • Ask us to correct information that is inaccurate or incomplete.
  • Ask us to delete information we no longer need to keep, subject to our legal record-keeping obligations.
  • Withdraw your consent to any use of your information that is based on consent.
  • Ask us to stop sending you marketing messages at any time, by clicking unsubscribe or by writing to [email protected].
  • Object to a particular use of your information, or ask us to restrict it, where grounds apply.

To exercise any of these choices, write to [email protected] from the email address we hold for you, or to the studio address above. We will respond within a reasonable time and at no cost in ordinary cases.

9. Keeping your information safe

We use reasonable technical and organisational measures to protect your personal information from unauthorised access, loss, or misuse, including encrypted connections (HTTPS), access controls, and routine backups of our systems. No method of transmission over the internet is completely secure, and we cannot guarantee absolute security.

10. Links to other websites

Our website may link to other sites (for example, our social media profiles or a payment processor's page). We are not responsible for the privacy practices of those sites. Please read their policies before providing them with any personal information.

11. Changes to this policy

We may update this policy from time to time to reflect changes in our practices or in Kuwaiti law. When we do, we will update the "Last updated" date at the top of this page and, where changes are significant, notify you via the website or by email.

12. Governing law and disputes

This policy is governed by the laws of the State of Kuwait. Any dispute arising out of or in connection with this policy, or any processing of your personal information by us, will be subject to the exclusive jurisdiction of the competent courts of Kuwait.
